1. Acceptance of Terms

By downloading, installing, or using the MaachGuru (মাছগুরু) mobile application or web platform (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and MaachGuru (“we,” “our,” or “us”), operated from West Bengal, India.

2. Description of Service

MaachGuru is a comprehensive fish farming management platform that provides:

• Fish market rate information across West Bengal
• Pond management and tracking tools
• Water quality monitoring
• AI-powered disease detection
• Government scheme information and eligibility checking
• Buyer-seller marketplace with messaging
• Weather alerts and forecasts
• Financial management tools
• Voice-based accessibility features

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account by providing your phone number and verifying it via OTP. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, fraudulent activity, or prolonged inactivity.

4. User Responsibilities

You agree to:

• Use the Service only for lawful purposes related to fish farming and aquaculture
• Provide accurate information about your farm, fish, and listings
• Not engage in fraudulent, misleading, or deceptive practices
• Not manipulate market prices or engage in price-fixing
• Not harass, abuse, or harm other users
• Not attempt to gain unauthorized access to the Service or other users' accounts
• Not use automated systems or bots to access the Service
• Comply with all applicable laws and regulations

5. Marketplace and Transactions

5.1 Listings

When creating a fish listing, you must provide accurate information including species, weight, price, quality grade, and location. Misrepresentation of products is strictly prohibited.

5.2 Transactions

MaachGuru facilitates connections between buyers and sellers but is not a party to any transaction. We do not guarantee the quality, safety, or legality of items listed, nor the ability of buyers to pay or sellers to deliver.

5.3 Payments

Payments are processed through third-party payment providers (Razorpay, PhonePe). We do not store your payment card details. You agree to the terms and conditions of these payment providers.

5.4 Disputes

Any disputes between buyers and sellers must be resolved between the parties involved. MaachGuru may, at its discretion, assist in dispute resolution but is not obligated to do so.

6. AI and Automated Services

6.1 Disease Detection

Our AI disease detection feature provides preliminary analysis only. Results should not be considered as professional veterinary advice. Always consult a qualified fisheries expert or veterinarian for proper diagnosis and treatment.

6.2 AI Copilot

The AI Copilot provides information and suggestions based on available data. While we strive for accuracy, AI-generated responses may contain errors. Use this feature as a辅助 tool, not as a replacement for professional expertise.

6.3 Price Predictions

Market price predictions and forecasts are estimates based on historical data and AI analysis. Actual prices may vary significantly. We do not guarantee the accuracy of price predictions and are not liable for any losses resulting from reliance on such predictions.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by MaachGuru and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service, including farm data, photos, and listings. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating the Service.

8. Limitation of Liability

To the maximum extent permitted by law, MaachGuru shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages resulting from transactions between users
• Inaccuracies in market rates or AI predictions
• Service interruptions or technical issues
• Unauthorized access to your account or data
• Any damages arising from use of third-party services

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us, if any, in the past 12 months.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any products, services, or information obtained through the Service will meet your expectations
• Any errors in the Service will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless MaachGuru and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct in connection with the Service

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in West Bengal, India.
